Senate debates protecting American voter eligibility (save) America Law.
Voting rights organizations, civil rights groups and others warn that the bill would create unprecedented barriers to voting, potentially disenfranchising. Millions of eligible voters. but President Trump asserted that it was “one of the most important and consequential pieces of legislation in Congress and American history.” he We need to stop “fraud” in our elections.
Yet voter fraud is exceptionally rare. as Brennan Center for Justice In conclusion, “it simply could not and would not happen at anywhere near the rate required to ‘rigg’ the election.”
The real purpose of the Save America Act is not to make elections safer. It’s about exploiting public fears about marginalized groups — in this case, immigrants and transgender people — seizing more power.
Importantly, in addition to imposing onerous voter ID and proof of citizenship requirements that many eligible voters will be unable to meet, Save America Act Also prohibits transgender athletes from competing in women’s sports and gender-affirming care for trans youth. If the objective was to improve election security, these provisions would have been out of place.
The Trump administration, however, knows it lacks any evidence to back-up its false claims. So instead of facts, they spread lies about immigrants and trans people to change how voters perceive the risks of the upcoming election.
Rather than a democratic contest between different candidates offering distinct visions for the country, Trump wants people to truly believe that “Very bad thingHappens if Democrats win the midterms. He hopes that fear will motivate Republicans to pass the Save America Act, and distract people from the real dangers of the law.
The reality is that “very bad things” will happen if the Save America Act passes.
For one thing, it will Strictly limit mail-in votingThat could especially affect elderly, disabled and rural voters, and millions more in states that have conducted mail-in elections for years. Protecting vote-by-mail should not be a partisan issue – Even President Trump himself voted by mail this year.
For another, Americans must present a passport or birth certificate to show their majority Proof of citizenship – A driver’s license or state ID will often be insufficient. However, more than 140 million US citizens do not have a passport and 69 million married women do not have a birth certificate that matches their legal name.
Beyond these barriers, determining proof of citizenship is highly vulnerable to abuse. If verification of these documents is left entirely to election officials — or worse, the Department of Homeland Security — it could be used to further disenfranchise voters.
We have already seen similar abuses by ICE.
For example, in December 2025, Dulce Consuelo Díaz MoralesA US-born citizen, was detained by ICE on suspicion of being an undocumented immigrant His family and lawyers submitted proof of his citizenship status, including his birth certificate and immunization records.
Yet a DHS official insisted the documents were not valid. Diaz Morales spent 25 days in ICE custody before being released. His rights were denied because DHS judged that proof of his citizenship was insufficient evidence.
This should concern us all.
In February 2026, then Homeland Security Secretary Christie Noem He claimed to have the power to identify “weaknesses” in the electoral system and implement “mitigative measures” to ensure “proper conduct” of elections. He commented that DHS will ensure that “we have the right people voted in, the right leaders elected to lead this country through our days.”
The Save America Act is not about preventing election fraud. It’s about paving the way for Trump to abuse his legislative power to rig the election. He is scapegoating immigrants and transgenders to further his authoritarian goals.
We can’t let that happen. To save America, we must ensure that the Save America Act never passes.
